MSC106/19/Add.1Annex 8,page 1ANNEX 8RESOLUTION MSC.526(106)(adopted on 10 November 2022)AMENDMENTS TO THE INTERNATIONAL CODE FOR THE CONSTRUCTION ANDEQUIPMENT OF SHIPS CARRYING DANGEROUS CHEMICALS IN BULK(IBC CODE)THE MARITIME SAFETY COMMITTEE.RECALLING Article 28(b)of the Convention on the International Maritime Organizationconcerning the functions of the Committee,RECALLING ALSO resolution MSC.4(48),by which it adopted the International Code for theConstruction and Equipment of Ships Carrying Dangerous Chemicals in Bulk("the IBC Code"),which has become mandatory under chapter Vll of the International Convention for the Safetyof Life at Sea,1974 ("the Convention"),RECALLING FURTHER article VIIl(b)and regulation Vll/8.1 of the Convention concerning theprocedure for amending the IBC Code,NOTING that the Marine Environment Protection Committee,at its seventy-eighth session,adopted amendments to the IBC Code concerning watertight doors by resolutionMEPC.345(78),for concurrent adoption by the Maritime Safety Committee,HAVING CONSIDERED,at its 106th session,amendments to the IBC Code proposed andcirculated in accordance with article VIll(b)(i)of the Convention,ADOPTS,in accordance with article VIll(b)(iv)of the Convention,amendments to theIBC Code the text of which is set out in the annex to the present resolution;DETERMINES,in accordance with article VIll(b)(vi)(2)(bb)of the Convention,that thesaid amendments shall be deemed to have been accepted on 1 January 2024,unless,prior tothat date,more than one third of the Contracting Govemments to the Convention orContracting Governments the combined merchant fleets of which constitute not less than 50%of the gross tonnage of the world's merchant fleet have notified their objections to theamendments;3INVITES Contracting Governments to the Convention to note that,in accordance witharticle VIll(b)(vii)(2)of the Convention,the amendments shall enter into force on 1 July 2024upon their acceptance in accordance with paragraph 2 above;REQUESTS the Secretary-General,for the purposes of article VIll(b)(v)of theConvention,to transmit certified copies of the present resolution and the text of theamendments contained in the annex to all Contracting Governments to the Convention;5ALSO REQUESTS the Secretary-General to transmit copies of this resolution and itsannex to Members of the Organization which are not Contracting Governments to theConvention.I:MSC106MSC 106/19/Add.1.docx
