MEPC 81/16/Add.1Annex 4,page 1ANNEX 4RESOLUTION MEPC.386(81)(adopted on 22 March 2024)2024 GUIDELINES AS REQUIRED BY REGULATION 13.2.2 OF MARPOL ANNEX VIIN RESPECT OF NON-IDENTICAL REPLACEMENT ENGINES NOT REQUIRED TOMEET THE TIER III LIMITTHE MARINE ENVIRONMENT PROTECTION COMMITTEE.RECALLING Article 38(a)of the Convention on the International Maritime Organizationconcerning the functions of the Marine Environment Protection Committee conferred upon itby international conventions for the prevention and control of marine pollution,RECALLING ALSO that,at its fifty-eighth session,it adopted,by resolution MEPC.176(58),arevised MARPOL Annex VI(hereinafter referred to as "MARPOL Annex VI")which significantlystrengthens the emission limits for nitrogen oxides(NOx)in light of technological improvementsand implementation experience,NOTING that regulation 13.2.2 of MARPOL Annex VI specifies which NOx emission standardshall be applied when a marine diesel engine is replaced with a non-identical marine dieselengine,RECOGNIZING the need to develop guidelines to set forth criteria for when it is not possiblefor a replacement engine to meet the standards in regulation 13.5.1.1 (Tier Ill),RECALLING that,at its sixty-fifth session,it adopted,by resolution MEPC.230(65),the 2013Guidelines as required by regulation 13.2.2 of MARPOL Annex VI in respect of non-identicalreplacement engines not required to meet the Tier Ill limit (hereinafter referred to as the"2013 Guidelines"),RECOGNIZING the need to update the 2013 Guidelines,HAVING CONSIDERED,at its eighty-first session,the draft 2024 Guidelines as required byregulation 13.2.2 of MARPOL Annex VI in respect of non-identical replacement engines notreguired to meet the Tier/ll limit,prepared by the Sub-Committee on Pollution Prevention andResponse at its tenth session,ADOPTS the 2024 Guidelines as required by regulation 13.2.2 of MARPOL Annex VIin respect of non-identical replacement engines not required to meet the Tier Ill limit,as setout in the annex to the present resolution;2INVITES Administrations to take the annexed Guidelines into account whenconsidering whether the installation of a Tier Ill marine diesel engine is not feasible in the caseof a non-identical marine diesel engine;REQUESTS the Parties to MARPOL Annex VI and other Member Govemments tobring the annexed Guidelines to the attention of shipowners,ship operators,shipbuilders,marine diesel engine manufacturers and any other interested groups;I:MEPC81MEPC 81-16-Add.1.docx
