MSC107/20/Add.1Annex 5,page 1ANNEX 5RESOLUTION MSC.535(107)(adopted on 8 June 2023)AMENDMENTS TO THE INTERNATIONAL LIFE-SAVING APPLIANCE CODE(LSA CODE)THE MARITIME SAFETY COMMITTEE.RECALLING Article 28(b)of the Convention on the International Maritime Organizationconcerning the functions of the Committee,RECALLING ALSO resolution MSC.48(66),by which it adopted the International Life-SavingAppliance (LSA)Code ("the LSA Code"),which has become mandatory under chapter Ill ofthe International Convention for the Safety of Life at Sea(SOLAS),1974 ("the Convention"),RECALLING FURTHER article VIll(b)and regulation Ill/3.10 of the Convention concerning theprocedure for amending the LSA Code,HAVING CONSIDERED,at its 107th session,amendments to the LSA Code proposed andcirculated in accordance with article VIll(b)(i)of the Convention,1ADOPTS,in accordance with article VIll(b)(iv)of the Convention,amendments to theLSA Code,the text of which is set out in the annex to the present resolution;DETERMINES,in accordance with article VIll(b)(vi)(2)(bb)of the Convention,that theamendments shall be deemed to have been accepted on 1 July 2025 unless,prior to that date,more than one third of the Contracting Governments to the Convention or ContractingGovernments,the combined merchant fleets of which constitute not less than 50%of the grosstonnage of the world's merchant fleet,have notified their objections to the amendments;3INVITES Contracting Governments to note that,in accordance witharticle VIll(b)(vii)(2)of the Convention,the amendments shall enter into forceon 1 January 2026 upon their acceptance in accordance with paragraph 2 above;4ALSO INVITES Contracting Government to note that the provisions in the annex areto be applied to totally enclosed lifeboats installed on or after 1 January 2029 where theexpression installed on or after 1 January 2029 means:(a)for ships for which the building contract is placed on or after 1 January 2029,or in the absence of the contract,constructed on or after 1 January 2029,any installation date on the ship;or(b)for ships other than those ships prescribed in (a)above,a contractualdelivery date for the equipment or,in the absence of a contractual deliverydate,the actual delivery date of the equipment to the ship on orafter 1 January 2029.5REQUESTS the Secretary-General,in conformity with article VIll(b)(v)of theConvention,to transmit certified copies of the present resolution and the text of theamendments contained in the annex to all Contracting Governments to the Convention;6ALSO REQUESTS the Secretary-General to transmit copies of this resolution and itsannex to Members of the Organization which are not Contracting Governments to theConvention.I:MSC107MSC 107/20/Add.1.docx
